Pointing out that Maharashtra police h t filed an FIR in case yet, Centre argued that '56 statements recorded' by state police h backing in law in absence of 'investigation'. affidavit has also claimed that as Maharashtra police can start an investigation after filing an FIR, it does t get jurisdiction to record statements. It stated that police were required to intimate nearest executive magistrate and draw up a report of apparent cause of death, description of body, marks or weapons found on or near body - prior to filing an FIR.
