Linda Fairstein to sue Netflix over her portrayal in 'When They See Us'
As Linda Fairstein sued Netflix and the writer, Attica Locke for defaming her in the series, the court has now given her the opportunity to pursue the claims.

Popular American author Linda Fairstein w has a credible claim against Netflix that she was defamed by When y See Us, Netflix series from Ava DuVernay about Central Park Five case. As she filed a suit against Netflix, DuVernay and writer Attica Locke in March 2020 for portraying her as a “racist, unethical villain” who framed five young men for rape.

According to reports by Variety, as Linda Fairstein sued Netflix in 2020, y came up with an argument that show was protected by First Amendment. y furr argued that filmmakers were allowed to use some dramatic license in creating her character that was substantially true. While US Judge, Kevin Castel rejected numerous allegations me by Fairstein, he did agree that five of scenes could’ve been defamatory.

In a statement, US Judge wrote, “ aver viewer could conclude that se scenes have a basis in fact and do t merely reflect creators’ opinions about controversial historical events.”
Andrew Miltenberg, Fairstein’s attorney, was ‘extremely pleased’ by decision and stated, “We are gl that Ms. Fairstein w has opportunity to pursue her claims with respect to five critical scenes in series that falsely depict Ms. Fairstein engaging in coercive and discriminatory conduct in order to build a case against incent young men of color,”

On or hand, Netflix issued a statement thanking Judge Castel for his thoughtful assessment of issues and ded that y will continue to vigorously defend When y See Us and incredible team behind series. y also stated that y were confident that y would prevail against Ms. Fairstein’s few remaining claims.
As Judge, Castel allowed Fairstein to take her case ahe, he furr stated, “ aver viewer would t necessarily conclude that her remarks were merely a reflection of filmmakers’ opinions about perspective of law enforcement, and could inste conclude that Fairstein directed discriminatory policing practices.”

“ question of wher defendants actually agreed to defame Fairstein is properly subject to discovery, but opprobrium expressed toward Fairstein in certain of defendants’ public comments lend some plausibility to claim,” judge wrote.
