Republic TV has accessed the third affidavit filed by Congress president Rahul Gandhi in the Supreme Court over the contempt of court petition moved against him by BJP MP Meenakshi Lekhi for misattributing his 'Chowkidar Chor Hai' attack to its order in the Rafale review petitions.

Republic TV has accessed third affidavit filed by Congress president Rahul Gandhi in Supreme Court over contempt of court petition moved against him by BJP MP Meenakshi Lekhi for misattributing his 'Chowkidar Chor Hai' attack to its order in Rafale review petitions.

affidavit contains his 'unconditional apology' after Supreme Court bench h been unsatisfied with 'expression of regret' that he h me earlier citing that remarks in question h been me 'in heat of political campaigning'. case will next be taken up on Friday.

Here are contents of apology:

I, Rahul Gandhi, S/o Late Shri Rajiv Gandhi, d 48 years, R/o 12 Tughlak Lane, New Delhi 110011, do hereby solemnly affirm and declare as under: Vide order dated 30.04.2019, this Hon'ble Court was pleased to pass following order:-

“We have heard learned counsel for parties. After an extensive hearing Dr. Abhishek Manu Singhvi, learned senior counsel for respondent, seeks liberty to file an ditional affidavit. While we observe that it will be open for respondent to file ditional affidavit if he so desires, we make it clear that missibility and acceptance of any affidavit, if filed, will be considered on next date fixed i.e. 10.05.2019.”

instant affidavit is being filed pursuant to gracious liberty granted by this Hon'ble Court vide order aforementioned order dated 30.04.2019.

3.    At outset, Deponent herein most respectfully submits that he holds this Hon'ble Court in highest esteem and respect. Deponent has never sought or intended to, directly or indirectly, commit any act that interferes with process of ministration of justice.

4.     Deponent unconditionally apologises for wrongful attributions to this Hon’ble Court. Deponent furr states that any such attributions were entirely unintentional, n-willful and invertent.

5.     Deponent most respectfully prays that this Hon'ble Court may be graciously pleased to accept instant affidavit and close present contempt proceedings.

6.    That present affidavit is me bona fide and in interest of justice and thing material has been concealed refrom. 

7.    That contents of above affidavit are true and correct to my kwledge and belief and thing material is concealed refrom.

Supreme Court h earlier voiced its dissatisfaction with Rahul Gandhi's earlier 'expression of regret', with Chief Justice of India Ranjan Gogoi asking if 'expression of regret' quantifies as an apology.

Justice Sanjay Kishen Kaul h n warned Rahul Gandhi's counsel Abhishek Manu Singhvi saying, "when you make a mistake, you should accept that you’ve me a mistake." This led to Singhvi saying for first time that Rahul Gandhi apologizes for that statement.

apology is important as a contempt plea and a contempt affidavit usually have an unconditional apology in first paragraph.

dressing a news briefing on Saturday, Congress president h explained his 'regret':

"In Rafale deal, Chowkidar has stolen Rs 30,000 crore. w you ask about my apology to Supreme Court. Absolutely I have apologised to Supreme Court. I will tell you why. Because a process was ongoing in Supreme Court and I commented on process and that isn't my place. So I apologised." 

He ded, "But 'Chowkidar chor hai' is a slogan, it's truth, it's a reality. And I am t apologising to Narendra Modi, BJP or anyone else. I apologised because mid-process I gave an opinion about Supreme Court and that was a mistake, hence I apologised."

specific remarks over which controversy broke out was me after Rahul Gandhi h filed his Amethi mination papers and in ensuing media interaction, h said:

"Supreme Court ne nyay ke bare mai baat ke hai. Supreme Court said Chowkidar ne chori ke hai (Supreme Court will do justice. Supreme Court said that Chowkidar is involved in a ft)."

It was after this that Meenakshi Lekhi h filed her contempt plea.
