CJI Orders Removal Of All Photos Of Dead Body From Social Media In RG Kar Horror Case

New Delhi: While hearing the Kolkata Rape and Murder Case, the Supreme Court of India has ordered for the immediate removal of all photographs of the dead body, from social media. Important questions regarding tampering of evidence at RG Kar, Abhaya's postmortem and delay in filing of FIR among other issues have been raised.

During the ongoing hearing, senior advocate Geeta Luthra brought up the issue of photographs of the victim being circulated on social media. Geeta Luthra: One request- on social media, the photographs of the victim are being circulated, this should not be happening.
CJI: Where did you get those photos?

Geeta Luthra: The fact is they are being circulated, one person has given the names of 10-20 main miscreants in this hospital.
CJI: Damage has been done by circulation of these photographs. All photographs of the dead body are to be removed forthwith.

CBI to File Fresh Status Report Regarding Kolkata Case Investigation: SC
During the hearing in the Kolkata Rape and Murder case by the bench of Chief Justice DY Chandrachud and Justices JB Pardiwala and Manoj Misra, the top court has put forth some important questions before the government. The apex court has also sought a fresh status report from the Central Bureau of Investigation (CBI), regarding the ongoing probe in the case.

- CJI Seeks Clarification on Time of Unnatural Death: The Chief Justice of India, while hearing the case, has sought clarification on the time of the ‘unnatural death’ of the victim. He asked - “We want to know the time at which UD (unnatural death) 861/2024 came to be registered…” To this Kapil Sibal responded, “Death certificate given at 1:47 PM, entry UD at 2:55 PM at police station.”
- SC Seeks Fresh Status Report from CBI: “Status report has been filed by CBI, it appears that investigation is in progress, we direct the CBI to file fresh status report on so and so...we will take it upon tuesday, lets see what happens now and...CBI is doing it, we don't want to guide CBI on its investigation”, said CJI.
- Discrepancies Regarding Postmortem: Supreme Court has pointed at a 14-hour delay in filing of FIR and the counsel pointed at delay in filing of postmortem report - the Counsel said, “FIR at 11:45 at night, in the last 27 years of my career, I have never seen a case… PMR doesn't say at what time it is conducted, videograph- conducted by whom? Was it reiteratable or non-reiterable? It has to be mentioned, all the 3 female doctors are part of the lobby....see the second line it has to be at 4 degree centigrade."
- Challan for Postmortem ‘Missing': During the hearing, it has been highlighted how the challan form which must be mandatorily filed for conducting postmortem, is missing.
- ‘All Photos of Dead Body Must be Removed from Social Media’: CJI DY Chandrachud has ordered that all photographs of the dead body of the victim must be removed from social media with immediate effect.
- 'Protesting Doctors Must Resume Work by 5 pm Tomorrow': According to CJI, “State in affidavit indicated that funds have been sanctioned for carrying out the safety measures...this shall be monitored by the District Collectors. In order to create sense of confidence we state that in the event that doctors come to work by 5 PM tomorrow, not adverse actions.....if there is continuous abstention from work despite the facilities given there will be likelihood of action in future.”
