BIG: Supreme Court upholds disqualification of 17 Karnataka MLAs

The SC on Wednesday pronounced its judgement on 17 disqualified Karnataka MLAs and upheld the disqualification by the speaker & allowed them to contest bypolls

In a big breaking, Supreme Court on Wednesday prounced its judgement on 17 disqualified Karnataka MLAs and upheld disqualification by speaker. SC was hearing plea challenging disqualification of 17 MLA’s from Karnataka Assembly.  judgement was rendered by a three-judge bench comprising Justices NV Ramana, Sanjiv Khanna, and Krishna Murari. top court ded down period of disqualification.

While hearing case,  top court said that Speaker is a quasi-judicial authority.  power of speaker to bar member till end of term. Court said that MLAs can take part in December 5 bypolls.

Supreme Court while delivering its judgement said, "In a parliamentary democracy, application of constitutional democracy should be binding on government and opposition. We don’t appreciate manner in which petitioners kcked on doors of this court" SC also said that since a substantial amount of time has passed and to ensure exercise is t repeated before HC y h option but to deal with case on merits petitioners should've approached HC first.  SC also passed Disqualification order passed by speaker as he did t have power to indicate period for which one is disqualified.

What h disqualified MLAs alleged?

MLA’s h alleged disqualification is arbitrary.  Congress h alleged what h happened was a constitutional sin.  Petitions were filed by 17 ex-MLAs of Karnataka challenging ir disqualification by previous Speaker of Assembly.  resignation of 17 MLAs from Congress and JD(S) parties eventually brought down HD Kumaraswamy-led regime in Karnataka in July this year. y were reafter disqualified on grounds of defection by former Speaker, KR Ramesh.
