Citizens are entitled to brea fresh air, National Green Tribunal has said while dismissing a plea filed by a public sector distribution company seeking permission to use diesel generators. A bench heed by NGT Chairperson Justice arsh Kumar Goel junked a plea on Wednesday filed by Dakshin Haryana Bijli Vitaran Nigam seeking brear from Environment Pollution (Prevention and Control) Authority's (EPCA) order on banning use of diesel generators to combat air pollution in National Capital Region (NCR). petitioner h said that while it is under obligation to distribute electricity, re are limitations in distributing power in entire area due to technical n-feasibility.

"This makes it a compulsion to use diesel generator sets. appellant me a representation placing this difficulty for consideration by State Pollution Control Board and a copy of which has been marked to EPCA constituted under provisions of Environment (Protection) Act, 1986, but same has t been considered," it said.

EPCA on October 9 ordered that diesel generator sets will be banned in Delhi and nearby cities, such as Gurgaon, Faridab, ida, and Ghaziab, starting October 15. tribunal said that in view of fact that Gred Response Action Plan (GRAP) has been duly tified under provisions of Environment (Protection) Act, 1986, and is binding and that impugned order is merely enforcing GRAP, re is illegality in order. "Impugned action is an undoubted need for protection of environment and public health. If appellant cant supply electricity, it is for appellant to find out ways and means within purview of law. This cant be ground to use DG sets in violation of air quality protection rms. Citizens are entitled to brea in fresh air. Thus, interference is called for," NGT said.
