Arvind Kejriwal in HC to quash defamation complaint by Vijender Gupta

CM Kejriwal has moved the Delhi HC for quashing of the defamation complaint against him by BJP leader Vijender Gupta and summons issued to him in the matter.

Chief Minister Arvind Kejriwal has moved Delhi High Court for quashing of defamation complaint against him by BJP leer Vijender Gupta and summons issued to him in matter.

When matter came up for hearing before Justice Maj Kumar Ohri on Tuesday, judge observed that re was a high court ruling which said  wher re-tweets would constitute an offence of defamation under Indian Penal Code has to be determined during trial.

court asked Kejriwal's lawyers to go through judgement to ascertain wher it would be applicable in instant case and listed it for hearing on August 23.

Gupta, in his complaint, h accused Kejriwal and Deputy chief minister Manish Sisodia of "maligning" his im by allegedly accusing him on Twitter of being part of an alleged "conspiracy" to kill AAP chief.

AAP conver, represented by senior vocate Vikas Pahwa and vocate R Arunhri Iyer, has claimed that he h neir mentioned Gupta in his tweet r me any allegations against him.

His lawyers, however, mitted that AAP chief h re-tweeted Sisodia's tweet but with his own comment in which also Gupta was t mentioned by name.

Kejriwal, in his plea filed through vocate Mohd Irs, has contended that he has neir me any defamatory comment against Gupta r mentioned his name and refore, offence was t me out against him.

After Kejriwal was slapped in May this year during general election campaign, he h alleged on Twitter that Bharatiya Janata Party (BJP) wanted to get him killed by his own personal security officer (PSO) in manner in which Indira Gandhi h been assassinated.

In response to his comments, Gupta h said that Kejriwal was slapped because he h relaxed his security cordon.

To this, Sisodia h tweeted that re was a conspiracy to kill Kejriwal and that Gupta was allegedly part of it.
