Court dismisses plea seeking FIR against Baba Ramdev for falsely claiming to have found cure for COVID-19

A Delhi Court Thursday dismissed a plea seeking lodging of an FIR against yoga guru Baba Ramdev and ors for allegedly cheating people by falsely claiming that his firm Patanjali has found a cure for COVID-19, ting one case has already been registered.
Metropolitan Magistrate Sumit Anand observed that content of application were similar to one based on which an FIR has already lodged in Jaipur. order was passed after Delhi police filed a status report stating that an FIR has already been lodged under Section 420 (cheating) of IPC at Police Station Jyoti Nagar, Jaipur, Rajasthan on a similar plea.

It furr said that “AYUSH Ministry had allowed sale of 'Coronil' as an immunity booster and in case of any grievance, Complainant should approach Ministry.“ “ press conference during which 'Coronil' was launched was held at Haridwar, Uttrakhand which was beyond jurisdiction was Delhi Police,” police told court.
Taking te of police submission, judge said that “once re is already an FIR registered with respect to a cause of action, as raised by complainant herein, which is under investigation, re is occasion for this court to order registration of ar FIR on same cause of action, which will have effect of registration of multiple FIRs against same accused for same cause of action in different states.” application, filed by advocate Tushar Anand, claimed that Ramdev and or persons “only had permission to make/produce an immunity booster and y are falsely representing/making a false claim in media that y have found a cure for COVID-19”.

plea had sought lodging of FIR under various sections including 270 (malignant act likely to spread infection of disease dangerous), 420 (cheating) and 504 (intentionally insults with intent to provoke break of public peace).
“ accused persons are taking undue advant of media and have made a false representation to people who will buy product since, above said accused persons are claiming it to cure said deadly corona virus.

“By virtue of this accused persons in a pre planned hatched conspiracy with mala fide intentions to cause wrongful loss to public at large by making such mis-representations and with intention to cause wrongful gain to mselves and also producing a product for which y never claimed/received a license by concerned authorities,” plea had said.
