J&K: High Court Allows Party Members to meet Omar and Farooq Abdullah

High Court has permitted two Members of Parliament (MP) of the J&K National Conference (JKNC) party to meet Omar and Farooq Abdullah who are under house arrest.

High Court of Jammu and Kashmir has permitted two Members of Parliament (MP) of  J&K National Conference (JKNC) party to meet Omar Abdullah and Farooq Abdullah but has imposed some restrictions on m. HC has prohibited MPs from talking to media after y have met leer of JKNC. A petition was filed claiming two leers of being under house arrest since abrogation of Article 370. petitioners said y were worried about well-being of Omar and Farooq Abdullah.

' Formal Restrictions From Meeting Party Leers'

In a hearing in court, it was found out by ditional vocate General, Javed Iqbal and vocate General, DC Raina that petitioners were t restricted from meeting ir party leers. “ meeting shall be related to a courtesy call and to kw about well being of persons under detention. After meeting, petitioners shall t go press to share details and deliberations with detained leers,” court said regarding meeting with Omar and Farooq Abdullah.

Justice Kumar has asked meeting to take place during present week. “It would be appropriate if petitioners are permitted to meet aforesaid persons separately on different occasions, eir on same day or on different days,” Justice Kumar said. court order also said, “In short it was [] submission of learned vocate General that State may t be averse to meeting of petitioners with ir President and Vice President, provided petitioners ensure that y would t do anything aimed at vitiating peaceful atmosphere.”

Abrogation of Article 370

Article 370 of Indian Constitution is a 'temporary provision' which grants automous, special status to state. Article 370 was revoked in Jammu and Kashmir, making m a part of India on August 5 and removing special status granted to state. bill was passed by Parliament approving Jammu and Kashmir and Lakh being given status of Union Territories of India.

As per provisions of article, Parliament needs state government's concurrence for applying laws except for defence, foreign affairs, communications and finance. Hence, residents of state live under a separate set of laws, including citizenship, ownership of property, and fundamental rights, in comparison to rest of India.
