Katra Keshav Dev Temple land case remanded back by Allahabad HC to trial court in Mathura

Allahab High Court on Monday remanded back to a trial court in Mathura Katra Keshav Dev Temple-Shahi Masjid Idgah land dispute.

Disposing of ir petitions, Justice Prakash Pia remanded back matter to trial court.

A regular civil suit was filed on September 25, 2020 by some devotees before court of civil judge (senior division) of Mathura claiming right over a 13.37-acre property joining Katra Keshav Dev Temple which according to m is birthplace of Lord Krishna and for removal of mosque standing on it.

At time of presentation of suit, civil judge (senior division) did not register it as a civil suit and registered it as a miscellaneous case on ground that plaintiffs are not residents of Mathura.

On May 19 last year, district judge h directed civil judge (senior division) Mathura to decide case on merit after hearing parties.

On Monday, high court stated that summons have alrey been issued by trial court on May 26 last year for filing respective written statements and framing of issues and in light of above, petitions are disposed of by remanding matter back to trial court.

It also directed trial court to judicate suit after following due procedure as per law without being influenced by any observation or findings of district judge vide impugned order dated May 19, 2022.
