SC directs pvt employers and employees to negotiate on salary payment for lockdown

The Supreme Court today stated that State governments have to facilitate settlements between workers and employers for wages during the 54-day lockdown period.

Supreme Court today prounced its order on petitions challenging March 29 MHA order, which had made it compulsory for all private firms to pay ir employees full and complete ws during nationwide lockdown.

Several companies had approached Supreme Court challenging MHA order, stating that industries were facing huge losses during lockdown. In this regard, employers had asked Supreme Court to implement “ work, pay” rule or direct Centre to use ESI funds for payments during this time.

Supreme Court today stated that State governments have to facilitate settlements between workers and employers for ws during 54-day lockdown period. apex court ordered private firms to initiate negotiations with ir employees on issue of payment and decide at earliest what resolution can be reached.

Supreme Court also asked employers and employees to approach labour commissioners for resolution of any disputes between two.

Along with this, Supreme Court stated that matter has t been disposed off yet. matter has been kept for hearing in last week of July, while Centre has been directed to file a detailed response to petitions by n.

Justice Bhushan while prouncing order stated - “ industry can survive without workers. Thus employers and employee need to negotiate and settle among mselves. If y are t able to settle it among mselves, y need to approach concerned labour authorities to sort issues out”.

Supreme Court also clarified in its order that those employers or industries which were working during lockdown but t to ir full capacity can also enter into negotiations with ir employees. Furr, employees should be allowed to come back to work without prejudice to ongoing negotiations. matter will w be heard in last week of July.
