Challenging detention of former Jammu and Kashmir chief minister Omar Abdullah under Public Safety Act, his sister on Monday has moved Supreme Court. Senior vocate Kapil Sibal, appearing for petitioner, mentioned matter for urgent listing before a bench heed by Justice N V Ramana. Sibal told bench that y have filed a habeas corpus petition challenging detention of Abdullah under PSA and matter should be heard this week. bench agreed for an urgent listing of matter.

Omar, Mufti booked under PSA
Both former Chief Ministers were booked under PSA on night of February 6, barely a few hours before ir preventive detention was to end. leers were put under detention before abrogation of Article 370 in August last year. According to rules, preventive detention can be extended beyond six months only if an visory board, constituted two weeks before completion of 180-day period, recommends for that. However, such board was constituted and Jammu and Kashmir ministration was left with two choices -- eir to release m or slap PSA. Authorities cited proceedings of internal party meetings and social media influence of NC leer and former chief minister Omar Abdullah and "pro-separatist" stand of Mehbooba Mufti for booking m under stringent Public Safety Act (PSA).

Farooq Abdullah's detention
Omar's far, Farooq Abdullah, who is a five-time chief minister and currently a member of Lok Sabha, was booked in September last year under PSA, a law which was enacted by his far Sheikh Abdullah in 1978 to fight timber smugglers in state as y would easily get away with minimal detention those days.
Despite being detained under Public Safety Act, oddly, 81-year-old mainstream politician was recently included in a 21-member consultative committee on defense by government. Abdullah, in a letter, h condemned government for disallowing him to attend winter session of Parliament, wherein significant Bills were passed.
