SC dismisses Mahua Moitra's petition challenging exclusion of CM relief funds from CSR

The Supreme Court stated that there was no aggrieved party before the Court and that the issue should be raised in the Parliament.

Supreme Court of India refused to consider a petition filed by  All India Trinamool Congress (TMC) Mahua Moitra which challenged validity of Ministry of Corporate Affairs (MCA) circular excluding Chief Ministers from purview of Corporate Social Responsibility (CSR).

Moitra's petition rejected

petition read, " contribution to PM relief fund or any or fund set up for socio-ecomic comes under CSR. It cant come under schedule 8 at all. Can fall under schedule 12 because it doesn't cover subjects enlisted under schedule 8. This fund is t meant for socio-ecomic development"

Supreme Court stated that re was aggrieved party before Court and that  issue should be raised in Parliament. bench, consisting Justices Ashok Bhushan, Sanjay Kishan Kaul, and BR Gavai stated that SC can agree that fund might t be for socio-ecomic reasons but benefits of it can be considered in Parliament.
