In a massive development, Supreme Court on Wednesday, December 16, agreed to consider forming a uniform code in matters of divorce laws to remove amalies in different personal laws and implement a uniform system.
petition filed by vocate and BJP member Ashwini Kumar Uphyay seeks “uniform grounds for divorce” for all people across country irrespective of ir religion. petition asks for directions to be issued to central government to remove prejudices in personal laws and bring about a uniform code to be applied to all cases of divorce without discrimination on basis of religion, race, caste, sex or place of birth.

Supreme Court has sought response of Ministry of Home Affairs as well as Law Ministry on petition after stating that y were “cautiously” issuing tice in matter.

bench heed by Chief Justice of India was at first reluctant to entertain petition with CJI SA Bobde asking if petitioners “were asking for Supreme Court to encroach upon personal laws and remove distinction y create?”
Senior vocate Pinky Anand appearing for petitioner told Supreme Court that plea only sought removal of personal laws which were violative of Articles 14, 19 and 21.
