A special session court has granted relief to Aam Ami Party (AAP) MLA Maj Kumar from an earlier sentence. court has furr directed him to pay a fine of ₹10,000 in a case for obstructing election process at a polling station during 2013 assembly polls. ditional Session Judge Ajay Kumar Kuhar on Wednesday passed an order on an appeal filed by Kumar against an order passed by a magisterial court in which MLA was sentenced to three months in jail and imposed with a fine of ₹10,000 while acquitting him under Section 186 of Indian Penal Code (obstructing public servant in discharging of public function).

court furr upheld AAP MLA's conviction for disorderly conduct in or near polling stations (punishable under Section 131 of Representation of People Act). In its order, court ruled that Kumar, an MLA from East Delhi's Kondli constituency, h caused an obstruction in taking out EVMs and election materials from polling station but re was disturbance in casting of votes. "Imprisonment brings with it some undesired effects on life of a person. It is also ted that re is previous record of conviction against appellant and gravity of offence is t such as to call for incarceration of appellant. refore, having considered facts and circumstances of case, I am of view that sentence of fine as imposed by trial court would be sufficient to meet ends of justice," Kuhar said in order.

What is case?
case was lodged on basis of a complaint regarding hindrance in election process being created by over 50 protesters, led by n AAP candidate Kumar, at main gate of an MCD school, during 2013 Delhi assembly elections, which caused problems to voters. protestors h put a blocke and closed main gate of school which forced police and election staff to remain locked inside school premises. police also said that due to actions of protestors, polling process was impacted. It also caused hindrance for polling nts who were engd in ir duty.
