HC seeks AIIMS response on cancer patient's plea to provide treatment

Delhi High Court has sought response of Centre and AIIMS on a plea by a woman, suffering from fourth st of esophal cancer, seeking direction to hospital to provide her medical treatment. Justice Navin Chawla, in an interim order, asked All India Institute of Medical Sciences (AIIMS) to examine and render full treatment to woman if she goes re till January 16.
"Till next day of hearing, in case petitioner (woman) produces herself for examination/ treatment before respondent . 2 (AIIMS), it shall examine and render full treatment to petitioner," court said and listed matter for furr hearing on January 16.

52-year-old Shashi Bala filed a petition in high court seeking direction to AIIMS to provide her treatment according to her present medical condition and after considering her previous reports and tests conducted in two different hospitals. Esophal cancer is one arising from esophagus — food pipe that runs between throat and stomach.

vocates Lalit Naagar and Ashish Negi, appearing for woman, also sought direction to central government to frame guidelines to be followed by government hospitals wherein patient should be denied medical treatment if he/ she is earlier treated at some or hospital.
"Denial to mit or treat woman, who is suffering from fourth st of cancer, is violation of her fundamental rights... condition of woman is weak and fragile and if she is t treated by AIIMS, she might lose her life. Failure by AIIMS to provide timely medical treatment to a needy person abrogates his/ her right to life guaranteed under Article 21," plea said.

It said woman was earlier being treated at Batra Hospital and reafter at Rajiv Gandhi Cancer Institute and Research Centre but treatment was t satisfactory. plea said woman's son went to oncology department at AIIMS on December 6, where he came to kw about process for getting an appointment with doctor.
He got to kw that his mor's case comes under Gastro-Intestinal Clinic where a team of doctors will see patients and ir reports on December 11. On December 11, he visited AIIMS again to show reports and doctors refused treatment saying y would t "entertain or take outside cases," plea alleged. It claimed that doctors said y only take those cases where patient directly comes to m.
