CJI Questions FIR Delay and Orders Polygraph Report By Aug 23, 5 pm
- CJI: "What is the reason for (a) the FIR being lodged 14 hours late; (b) the principal of the college should have come straight to the college to file the FIR—whom is he protecting? (c) He resigned and was assigned to another college?"
- CJI: "But this does not justify the registration of the FIR at 11:30 PM when the body was recovered much earlier."
- Kapil Sibal: "All investigation was already conducted by then."
- CJI: "What is the reason why the FIR was registered after a 14-hour delay?"
- Kapil Sibal: "Parents said only after we give a formal complaint."
- CJI: "The principal should have directly registered an FIR. The moment he tendered his resignation, he was appointed as the principal of another college."

- Solicitor General (SG): "It came from your current client."
- Kapil Sibal: "You are focusing on the state of West Bengal and not the investigation."
- CJI: "Let the investigation go on by CBI into the death and let Kolkata Police probe the vandalism. We never said that normal law procedure will not be followed. Only that do not arrest for merely protesting."

SG Calls Doctor's Rape as 'Most Inhuman and Undignified'
- CJI: "We have seen the Case Diary; we can form the view of the moments of the police officers, what time was PMR etc., and finally the Unnatural Death registered at 11:30 PM."
- CJI: "In fact, it also matches with the FIR."
- Solicitor General (SG): "Lordships have 10:10? This is GDE (General Diary Entry)."
- Solicitor General (SG): "(Reads) A UD case has been registered - earlier was GDE, this UD was 23:30 and FIR at 23:45 PM. That is how the chronology is."
- Solicitor General (SG): "A girl has been raped in the most inhuman and undignified manner."
- Justice Manoj: "GDE is kept at station, CD carried to the spot. The inquest report states that the UD was registered at 9.8.24 at 10:30 hours."
- Kapil Sibal: "That's correct."
- Justice Misra: "The CD carries the steps of the police officials."
- CJI: "(Reads) After PMR and inquest, the body is handed over to the mother. After return to the police station, a UD case is registered. All police superiors were informed... - Sibal: They are showing GD of entire day... if you see magistrate report... Unnnatural Death time is mentioned.
- Justice Pardiwala: "The procedure followed in criminal law by the police is not something CrPC follows or I have seen in my 30 years. So is it true that post mortem was after UD report?"
- Sibal: "No, that is not correct."
- Justice Pardiwala: "Who is the Assistant Superintendent of Police? Her conduct is also very doubtful... why did she act in this manner?"
- Sibal: "She is a female."
- CJI: "Now see in your document... GD entry is at 5:20 AM, received info from the hospital that the lady was lying in half-naked condition at 10:10 AM. Medical board opined there is possibility of forceful sexual penetration... and GD entry shows the cordoning of area is after the post mortem."
- CJI: "GD recorded at 10:10 AM, phone call received that a PG lady doctor was found unconscious on the 3rd floor."
- CJI: "The dead body of victim, the board verbally opined that death was due to strangulation, possibility of sexual assault, this is possibility."

- Sibal: "Your lordships' suspicion is right."

Justice Pardiwala: "UD 861/24 was registered at what hours?"

- Chief Justice of India Chandrachud: "One aspect is very disturbing. The unnatural death entry was made at 10:10 am. The police was informed then that it was an unnatural death and disregarding all this, the demarcation of crime scene etc happened in the night?"
- Kapil Sibal (representing the West Bengal government): "No no no, I have given a timeline which is backed by videography."
- Solicitor General Tushar Mehta: "Give us also."
- Kapil Sibal: "Yes, we will."
- Solicitor General Tushar Mehta: "We should not request; you are bound to give this to CBI."
- Justice Misra: "Autopsy was conducted on the evening hours of the 9th; the GD entry of unnatural death recorded at 11:30 at night..."
- Kapil Sibal: "Allow me to place timeline minute by minute."
- Justice Pardiwala: "When was the Post Mortem done?"
- Kapil Sibal: "6:10-7:10 PM."
- Justice Pardiwala: "When you start performing the Post Mortem, it means that it’s a case of unnatural death. UD 861/24 was registered at 23:20 hours, 9th August. The GD entry and FIR recorded at 11:45 PM hours. Is this true?"
- Justice Pardiwala: "This is very surprising; post mortem precedes registration of the unnatural death!"

- Solicitor General Tushar Mehta: "First FIR was registered after cremation at 11:45 pm. Then they told parents that it is suicide, then death and then friends of the doctor at the hospital insisted on videography and thus they also suspected something is amiss."
