JNU case hearing LIVE: With Arvind Kejriwal government withholding sedition sanction, Delhi police to urge court to begin trial on other sections

Top sources have revealed to Republic TV and Republic Bharat the strategy of the Delhi Police pertaining to the 1,200-page JNU sedition case chargesheet filed against Kanhaiya Kumar, Umar Khalid and eight others as main accused.

Top sources have revealed to Republic TV and Republic Bharat the strategy of the Delhi Police pertaining to the 1,200-page JNU sedition case chargesheet filed against Kanhaiya Kumar, Umar Khalid and eight others as main accused.

While the Patiala House court had earlier declined to take cognisance of the chargesheet - with the Delhi government not giving its sanction  - the police is likely to now attempt a new strategy in its efforts.

As per inputs, if the Delhi Police fails to get a sanction for 124 A (sedition) from the state government, they will urge the court during the Wednesday hearing to take cognisance on the chargesheet of the other sections leaving the sedition charge aside for the time being.. 

In that case, the Patiala High Court may start trial on sections 323/465/471/143/147/149 and 120-B of the IPC.

"Our main case is on Sedition but if we are not getting the sanction from the state government, we will urge the court to take cognisance of the chargesheet on other sections, trial will start and in the meantime we will try to get a sanction," a top Delhi police official said on the condition of anonymity

The legal department of the Arvind Kejriwal's government has been declining to provide sanction for the sedition chargesheet.

Earlier, Republic Bharat had accessed videos that are a part of the probe, that show the anti-India slogans that had been hurled. The videos include the 'tukde tukde' slogans raised in February 2016 at a pro-Afzal Guru protest at the public institution. 

The slogans were:

  • In its charge sheet that ran into 1,200 pages, the Delhi Police had gone into great detail over the precise evidence against each of the main accused. Against the three JNU students, namely Kanhaiya Kumar, Umar Khalid, and Anirban Bhattacharya, the Delhi Police had listed a combination of documentary, oral and electronic evidence. Video evidence had also been heavily relied on to file charges against the seven Kashmir resident students who were named as main accused.
  • The video evidence, which has now been accessed by Republic TV, had been authenticated by Forensic labs, the police had stated, and statements had been taken from students, security guards and others.

Chargesheet filed, naming ten persons as main accused:

3 JNU students charged with sedition and criminal conspiracy, as per sources:

  • Kanhaiya Kumar
  • Umar Khalid
  • Anirban Bhattacharya

7 Kashmiris belonging to JNU/Jamia/ Aligarh Muslim University have also been charged with sedition: 

  • Aquib Hussain
  • Mujeeb Hussain
  • Muneeb Hussain
  • Umar Gul
  • Rayees Rasool
  • Basharat Ali
  • Khalid Bashir Bhat
