Karnataka High Court, on Thursday, rejected petition filed by Congress senior leer DK Shivakumar to squash summons issued by Enforcement Directorate in Delhi to personally appear for questioning in money laundering case. On January 17, ED h sent summons to DK Shivakumar to appear in front of m before February 8 to answer queries regarding cases filed against him and four ors including his family members. Just four days before ED deline, DK Shivakumar, on February 4 h approached Karnataka High Court with a petition to quash summons.
petition also questioned sanction granted by Principal Director of Income Tax (Investigation) on May 28, 2018 for prosecution. petition contested that Principal Director h jurisdiction r authority to grant sanction in case. And basis this, petition ditionally challenged special court of ecomic offences’s decision to take cognisance of offences. Karnataka HC bench heed by Justice Arvind Kumar took cognisance of allegation that over Rs 8.5 crores of unaccounted for cash was found in DK Shivakumar’s residence in Safdarjung Ro in Delhi and said that allegations were grave and former Karnataka minister should join ED enquiry.

Starting on August 3, IT department h conducted raids across 60 locations in Karnataka and Delhi on residences and offices of DK Shivakumar, his family and business associates. raids, which involved multiple teams of IT department, lasted over four days. In June, 2018, IT department filed a chargesheet against DK Shivakumar and four ors accusing him of wilfully attempting to eve tax, filing false income tax statements under IT act. It also filed charges of criminal conspiracy under Section 120B of IPC and accused him of transporting huge amounts of unaccounted cash through hawala channels along with two ors.

In March, 2019, ED submitted to Karnataka HC enforcement case information report (ECIR) filed against DK Shivakumar. It informed HC that properties of accused have been attached or seized by ncies and y were alrey in possession of documents related to case. y submitted that y were merely asking accused to answer questions by personal appearance.

Reacting to HC verdict, party colleagues of DK Shivakumar came out in his support. KPCC President Dinesh Gundurao responded by saying ‘I'm t going to comment on court's decision but BJP government has abused central investigating ncies.We have seen politics of hate practiced by BJP government in case of P Chidambaram. central government is afraid of Congress leers. Let investigation take place’.
