Court Acquits 4 Men Accused of Killing 2 During 2020 Delhi Riots

The court said that the prosecution could not prove that any of the accused persons was involved in the killing of Jakir and Hussain.

New Delhi: A Delhi court on Monday acquitted four men, who were accused in killing of two people during 2020 Norast Delhi riots, on ground that police failed to provide evidence against m. court observed that re was no evidence to prove that accused were part of riotous mob.

four men have been identified as Ashok, Ajay, Subham and Jitender Kumar, who were accused of killing Ashfaq Hussain and Jakir on February 25 during communal riots in Norast Delhi in year 2020.

Court observed that re was no evidence to prove that accused were involved in killing

In two separate orders passed last week, court said prosecution could not prove that any of accused persons was involved in killing of Jakir and Hussain.

"re is no evidence to even establish any of accused being part of rioters at given place and time. refore, all accused persons are acquitted of all charges alleged against m in this case," court said.

Regarding wher accused were part of a riotous mob that killed duo, court, in common observations, said eyewitness in cases turned hostile and did not support prosecution’s version.

re was, however, some circumstantial evidence as call details record (CDR), recovery of scissors, swords and clos worn by some of accused persons, based on ir alleged disclosure statements, it said.

court said it could not reach a concrete conclusion about presence of a particular person at a particular place, solely based on CDR.

"As far as swords and scissors recovered and relied upon by prosecution is concerned, it is not that se weapons were found with remnants of blood of deceased, to show that y were weapons through which deceased were killed," it said.

court said prosecution did not conduct any forensic examination to show that clos h bloodstains of deceased.

It said CCTV footage showing presence of accused persons as part of unlawful assembly which murdered duo was not played in court.

"Even in form of circumstantial evidence, re is nothing on record to establish presence of accused persons among rioters," court observed.

Thus, prosecution was unable to prove that accused persons were involved in duo’s killings, it said.
