MahaRERA finds Mindspace Realty developer guilty of duping homebuyers

MahaRERA recently found a Mindspace Realty Pvt Ltd guilty of indulging in unfair practices after he changed the date in the original copy of the agreement

A builder was recently found guilty of indulging in unfair practices after he changed date in original copy of agreement when he h mentioned a different date in draft agreement. Homebuyers Kishor and Sushma Surve approached Maharashtra Real Estate Regulatory Authority (MahaRERA) against developer Mind Realty Pvt Ltd.

According to homebuyers, builder h agreed to hand over possession of a booked flat in Chinchw in December 2018. same date was even mentioned in a draft of agreement. After that, developer took signature of homebuyers without showing m final date of possession mentioned in agreement. When y received original copy of agreement, y found that inste of December 2018, date was mentioned as December 2020.

developer failed to appear despite repeated tice, and hence complaint proceeded ex parte against m. B D Kapnis, Member, MahaRERA who was hearing case said, "I believe complainants to hold that respondents (developer) promised to hand over possession of flat by December 2018, but without informing m, developer incorporated date of possession as December 2020, in agreement. This is a deceptive practice on part of developer. Hence, I find that developer is guilty of indulging in unfair practice within section 7 of RERA," ted Kapnis in his order.

developer has to pay interest at rate of 10.4% to homebuyers on ir investment of Rs 42/69 lakh from January 2019, till possession of flat along with a sum of Rs 10,000

In a similar incident in August, Mumbai Police’s Ecomic Offences Wing (EOW) h registered an FIR against promoters of RNA Corp for allegedly duping 13 homebuyers of Rs 6.17 crore. group h promised m flats in its 64-storeyed residential project in Sewree.
