A petition has been filed in Delhi High Court seeking a direction to National Crime Records Bureau (NCRB)  to recognise and classify transs as a separate third in ir annual publication of Prison Statistics India. petition filed by a law gruate Karan Tripathi seeks an immediate and urgent intervention of court as process of data collection for next annual publication of Prison Statistics report 2020 by NCRB is alrey underway. plea filed in Delhi HC is set to come up for hearing before division bench on December 1.

Tripathi's vocates Yash Mishra and Akhil Hasija have urged court to give direction to authorities to make requisite policy and format amendment to include data on trans prisoners eir in latest Prison Statistics Report, 2019 or in subsequent reports. petition claims that to date, only 2 s appear in Prison Statistics report published by NCRB and re is a complete exclusion of third .

petition filed in Delhi HC said, "In light of growing neglect towards welfare of trans community, especially during COVID-19 and denial of basic necessities to trans community in general, it is difficult to imagine state of trans prisoners in jails where y are t even recognised as a third on paper, let alone in reality behind bars."

PIL has urged Delhi HC to direct NCRB to take necessary steps to ensure proper implementation of directions passed by Supreme Court of India in matter titled as 'National Legal Service Authority Vs Union of India'. It also sought directions to government to make sure that appropriate steps are taken for implementation of recommendations me in 2014 report, by Expert Committee on issues relating to transs acting under aegis and directions, in compliance with direction of Supreme Court. plea also seeks formulation of appropriate rules and laws that will govern protection of rights of marginalized trans community in prisons.
