Karnataka: EC opposes disqualified MLAs plea in Supreme Court
The Election Commission of India, in the SC, has opposed the plea of disqualified MLAs to stay the elections till the SC verdict on their petitioning.

Election Commission of India, in Supreme Court, has opposed plea of disqualified MLAs to stay elections till SC verdict on ir petitioning challenging former speaker’s actions. This comes two days after tification of dates for by-elections to 15 constituencies in Karnataka was anunced by EC. petitioners asked SC to stay elections to ir vacant former constituencies till it arrives at a verdict on former speaker, Ramesh Kumar’s ruling t just disqualifying m, but even barring m from contesting elections till end of term of 15th assembly session. SC bench comprising of Justices Krishna Murari, N V Ramana and Sanjiv Khanna has journed case to Wednesday, September 25th.

SC also served tices to former Karnataka speaker Ramesh Kumar, JD(S) and Congress to file ir objections in matter. Reacting to development, KPCC president Dinesh Gundurao said, ‘Attorneys for Congress will appear in Supreme Court on Thursday and put forth our arguments. We are confident that Speaker's decision in case of disqualified MLAs will be upheld by SC. EC has thing to do with this case’.
Appearing on behalf of petitioners, Mukul Rohatgi argued that legislators moved SC only after Ramesh Kumar refused to accept ir resignations. He ded that even if disqualification is to be upheld, MLAs should be allowed to contest by-polls. It is unconstitutional for his speaker to disqualify till end of assembly term, he said.

Senior vocate Kapil Sibal, representing former speaker sought more to file objections, claiming that Rohatgi has presented new arguments and facts and has asked for interim relief. EC too has sought to be me a party in case, saying that since stay is on its schedule for by-polls, EC’s point of view on matter should also be heard by EC. state election commission, sources indicate to Republic, are awaiting furr instructions from CEC.

Politically, while former legislators are pinning ir hopes on getting relief from SC and contests in by-polls, sources in BJP told Republic that y are exerting immense pressure on Karnataka CM BS Yediyurappa to keep or aspirants in BJP at bay and ensure y get tickets to ir respective constituencies.
