As delay over MLC nomination persists, Maha CM Uddhav Thackeray dials PM Modi: Sources

As per sources, Maharashtra Chief Minister Uddhav Thackeray h a telephonic conversation with Prime Minister Narendra Modi on Wednesday regarding Goverr Bhagat Singh Koshyari's inaction on Cabinet recommendation to minate him to state Legislative Council. Thackeray reportedly conveyed to PM that some BJP leers in state were creating a roblock for him. On Tuesday, senior ministers of Maha Vikas Aghi government personally met Goverr requesting him to consider Thackeray's mination. Despite being sworn in as Maharashtra CM on vember 28, 2019, Shiv Sena chief is yet to be elected to Legislative Assembly or Legislative Council.

hurdle for MLC post
As per Article 164(4) of Constitution, a n-legislator ceases to be a minister if he is t elected to eir House of legislature within a period of 6 months. Thackeray was set to be fielded as a candidate to one of 9 MLC seats falling vacant on April 24. However, Election Commission of India indefinitely postponed Rajya Sabha and Legislative Council polls in current period owing to COVID-19 crisis. Thus, only option for Thackeray is to enter Legislative Council as a minated member.
While two of 12 minated member seats are vacant at moment, ir term expires on June 6, 2020. Moreover, Section 151 A of Representation of People Act, 1951 says that election to post cant be done if “ remainder of term of a member in relation to a vacancy is less than one year”. However, it is unclear wher this provision applies to minated members as well.

Sanjay Raut questions intentions of Goverr
Earlier in day, sources revealed that Maharashtra government is contemplating approaching Election Commission of India asking for an election to Legislative Council to be scheduled while maintaining social distancing rms. re is also a possibility that MVA leers might seek relief from Supreme Court. Maharashtra Cabinet h originally approved Thackeray's name for Legislative Council on April 9. While MVA leers have refrained from commenting on this issue, Sena Rajya Sabha MP Sanjay Raut recently warned against Raj Bhavan becoming a "centre for political conspiracy".
