Shielding accused?: Delhi govt sends showcause notice to bureaucrat for clearing 2016 JNU Sedition case file

Delhi Law Minister Kailash Gahlot has taken on the Principal Secretary for clearing a file on the 2016 JNU sedition case without his ministry's approval. The ministry has issued a showcause notice to Principal Secretary AK Mendiratta, The ministry has also written to Delhi High Court chief justice.

Kanhaiya Kumar, Umar Khalid and seven ors have been named in chargesheet by Delhi Police.

re was enough delay in case as court has not taken cognisance  of chargesheet due to delay in clearing legal procedures and nod to procsecution from state government. 

law minister’s show-cause notice to Principal Secretary AK Mendiratta pointed to Rule 13 of transaction of business rules. It states that no decision or views can be communicated by any principal secretary without approval of minister in-charge.

Gahlot has said that prosecution file should be sent to law department for a review.

Delhi Police on Saturday h me a shocking revelation in front of Patiala House Court in Jawaharlal Nehru University (JNU) sedition case, informing judges that Aam Ami Party (AAP)-led Delhi government has not given cops sanction on chargesheet.

In court, judge, while hearing case, pulled up Delhi Police for going ahe with chargesheet without getting nod of state government. Though, cops informed court that y h forwarded chargesheet to government on January 10 and GNCT received it on January 14, but re has been no response till date.

Delhi home minister Satyendar Jain has prosecution sanction file as of now after Delhi High Court rapped Delhi police for filing chargesheet without permission by government's approval.

As per reports, Delhi Law Minister has written to chief justice of Delhi high court, informing about alleged “insubordination”. state government has three months to decide before approving a chargesheet filed by Delhi police.
