This is the Gazette notice imposing President's rule in Maharashra

President Ram Nath Kovind’s proclamation of imposing President’s Rule in Maharashtra was published in the Gazette of India on Tuesday. The President stated that he took this decision after examining the report of Maharashtra Governor Bhagat Singh Koshyari. In this regard, he exercised powers under Article 356 of the Constitution.

“Whereas, I, Ram Nath Kovind, President of India, have received a report from the Governor of the State of Maharashtra and after considering the report and other information received by me, I am satisfied that a situation has arisen in which the Government of that State cannot be carried on in accordance with the provisions of the Constitution of India (hereinafter referred to as the Constitution); Now, therefore, in exercise of the powers conferred by article 356 of the Constitution, and of all other powers enabling me in that behalf, I hereby proclaim that I – (a) assume to myself as President of India all functions of the Government of the said State and all powers vested in or exercisable by the Governor of that State; (b) declare that the powers of the Legislature of the said State shall be exercisable by or under the authority of Parliament”

Power vacuum in Maharashtra

Despite the BJP-Shiv Sena alliance securing a comfortable majority in the Maharashtra Assembly elections, they could not form the government owing to a dispute over the Chief Minister’s post. After caretaker Chief Minister Devendra Fadnavis and the Sena supremo Uddhav Thackeray traded barbs on November 8, BJP refused to accept the invite to form the government. While the Sena expressed its willingness for government formation, it requested 48 hours to garner the letters of support from the MLAs. This request was rejected by the Governor after which he invited NCP, the third-largest party. However, when the NCP too asked for more time, the Governor recommended the imposition of President's Rule in the state.
