We Are Not Remedy For Everything: SC Rejects Plea for Probe Into Netaji Subhash Chandra Bose's Death

The Supreme Court rejected the plea seeking a probe into the death of Netaji Subhash Chandra Bose. It noted that SC is not the remedy and expert on all issues.

New Delhi: Rejecting the petition seeking an inquiry into the death of Netaji Subhash Chandra Bose, the Supreme Court said on Monday that the court is not the remedy for every problem, and such matters are not under its purview.

The top court noted that it can’t decide on such matters, and it is not the judiciary's job to run the government.

The petitioner noted before the apex court that Netaji Subhash Chandra Bose’s death still remains a mystery and no certain conclusion has been made relating to his disappearance.

'We Are Not Experts of Everything, Not Remedy of Every Problem'

"We are not experts in everything," the apex court said and asked the petitioner who claimed to be a political worker to raise such matters on the political platforms.

"Supreme Court har cheez ki dawa nahi hai. Sarkar ko chalana court ka kaam nahi hai (The Supreme Court is not a remedy for everything. It is not the Court's job to run the government)," Justice Kant said. 

A bench of Justices Surya Kant and Ujjal Bhuyan declined to entertain the plea, advising the petitioner to approach the appropriate forum. 

Justice Kant further clarified that the court's role is to address legal matters and urged the petitioner to raise their concerns in the proper forum.

How Did Netaji Subhash Chandra Bose Die?

The controversy over the death of Netaji Subhas Chandra Bose ('Netaji' for short), surfaced after the announcement from Tokyo on August 23, 1945 that Netaji had died in a plane crash on August 18, 1945. However, some press reports published from Tokyo and Taihoku (Taipei) had given contradictory versions. 

After the Independence of India, there was a popular demand for an inquiry into the alleged disappearance/death of Netaji. The issue was also raised in the Parliament from time to time. 

Justice Mukherjee Commission of Inquiry which was set up in 1999 came to a conclusion that Netaji Subhash Chandra Bose was not killed in the plane crash.

The commission completely rejected the ‘plane crash death’ premise while noting that there is not one positive evidence to suggest the same.
