Sourav Ganguly unlikely to retain BCCI Presidency? Legal experts justify bold claim

Legal experts speaking to SportzFront have suggested that it will be difficult for Sourav Ganguly and Jay Shah to retain their respective offices.

Sourav Ganguly’s tenure as BCCI President has come to an end, with former Indian captain’s short tenure officially ending on Monday. Along with Sourav Ganguly, even Jay Shah’s tenure, who serves as secretary has reached its culmination as well, after his tenure in cricket ministration came to an end last month. According to rule book, both Sourav Ganguly and Jay Shah will w have to serve a cooling-off period, wherein y have to undergo a three-year break before y can return to BCCI setup. However, that doesn’t mean that Sourav Ganguly will be unable to retain his BCCI Presidency, with matter currently hinging on Supreme Court’s ruling next month.

Sourav Ganguly’s chances to retain BCCI Presidency slim: Legal experts

Reporting on Ganguly BCCI President issue, SportzFront has w suggested that former Indian captain may t be able to continue as BCCI President. According to ir discussion with legal experts on issue, website suggested that it will be difficult for Apex Council or Apex Court to help Ganguly or Shah stay in ir respective offices. A senior lawyer explained that BCCI constitution will t permit Sourav Ganguly or Jay Shah to seek re-election without a cooling-off period. lawyer explained that w vacant positions of BCCI President and Secretary will have to be filled by an election process within 45 days as positions have become vacant moment elected representatives completed ir term.

Expounding furr on issue, lawyer told SportzFront that technically, BCCI have lost ir opportunity to get an extension for Ganguly and Shah, as law only empowered court to grant an extension while two were in office. Since tenure of duo has lapsed, re is law under which y could be re-instated. lawyer also said that he was unsure of fact that wher application for reinstatement will be even accepted or t, concluding that a clear decision will be available when Supreme Court hears case on August 17.

Speaking about Apex Council resolution that aimed to grant an extension to duo, lawyer mentioned that BCCI constitution could only be amended by a vote in General Body, for which court’s permission is mandatory. He explained that only after an amendment is passed, could Ganguly and Shah have gotten desired extension. Expressing his doubt on wher Sourav Ganguly will be able to return as BCCI President straight away, ar lawyer told website that one, including BCCI, can defy constitution.

All eyes will w be on Supreme Court’s ruling on August 17, where BCCI has petitioned for permission to amend constitution. While concluding on topic, lawyer said that while court has power to maintain status quo during pendency of case, it has power to re-minate Jay Shah and Sourav Ganguly. decision to extend tenure of duo can only be ratified after Supreme Court permits board to amend its constitution. Till that isn’t done, chances of Sourav Ganguly continuing his tenure as BCCI President remain bleak.
