US Court Terms Amazon Responsible For Defective Products Sold By Third-Party Sellers On Its Platform  

E-tailer Amazon could be held liable for defective products sold by third-party retailers through its platform, ruled a federal appeals court in the US.

E-tailer Amazon could be held liable for defective products sold by third-party retailers through its platform, ruled a federal appeals court in the US reversing a trend in which other court judgements had earlier ruled that non-liability for Amazon in case people report defects within products sold by sellers on its website. 

This ruling, according to a Reuters report, comes from an Appellate court in Philadelphia that has reversed the judgement of a lower court indicating non-compliance on Amazon’s part. The new ruling means that customers could hold the e-tailer responsible for products that are defective and sold by sellers using its platform.

At this point in time, Heather Oberdorf – an Amazon customer had reportedly purchased a dog leash on the e-platform in 2016 and she raised a complaint citing that the leash, caused bodily damages, as it recoiled resulting in reported blindness in one eye. She termed this product defective.  

This dog leash was reportedly sold by a seller called The Furry Gang on Amazon. Delivering the judgement, Reuters quotes the judge as having expressed that Amazon could be liable due to a gap between third-party sellers (selling via the e-tailer's platform) and customers. The judge, along with the judicial panel have now reportedly referred the case back to the lower court to judge if the leash dog leash bought by Oberdorf indeed contained defects.

Finally, Amazon is set to hold its Prime Day in India - Amazon Prime Day from 15 July till 16 July 2019. Like always, there would be a flurry of discounts on multiple important gadgets. There would also be new Amazon Prime releases as well during the Prime period.
