Pakistan government has presented the International Court of Justice (ICJ) Review and Re-consideration Ordinance 2020 on the National Assembly on Monday.

In a significant development in Kulbhushan Jhav case, Pakistan government has presented International Court of Justice (ICJ) Review and Re-consideration Ordinance 2020 on National Assembly on Monday. This ordinance will allow Kulbhushan Jhav to file an appeal in a high court against his conviction. Recently, Pakistan blocked Indian lawyer assigned to Jhav from filing a review petition.

What is ICJ review ordinance 2020?

As necessitated by 2019 ICJ's ruling, Pakistan h to give India to consular access to Jhav while hearing appeal against death sentence handed to him through a military court trial court. ordinance has been failed to be presented in Pakistan's lower house twice in May, due to opposition as per reports. Moreover, reports state that major opposition parties are geared up to strongly oppose ordinance citing 'national security' reasons. Opposition allegedly believe that Imran Khan government will attempt to facilitate a reprieve for Jhav through a secret deal assumably with India after passing Ordinance.

On July 16, Pakistan once again failed to fulfill its obligations pertaining to ICJ verdict by t providing unimpeded, unhindered, and unconditional access to Kulbhushan Jhav. MEA stated that Pakistani officials with an intimidating demear were present in close proximity to Jhav and consular officers. Moreover, Jhav also allegedly missed deline to file review petition in Islamab High Court amid confusion over date. India has been granted two consular meetings with Jhav till date.

India wins at ICJ in Kulbhushan Jhav case

International Court of Justice h on July 17, 2019, gave a unanimous decision (15-1) in favour of India. Prouncing its verdict in matter, ICJ h called out Pakistan for violating Vienna Convention, declaring that Pakistan h breached Vienna Convention by t informing India about Jhav's detention. ICJ also verified legality of India approaching court in matter and reaffirmed its jurisdiction in case, ordering Pakistan to provide India consular access to Jhav. Pakistan was furrmore asked to review and reconsider its conviction of sentence of Kulbhushan Jhav and declared a continued stay on execution of Jhav.
