In 2018, a lower court h n refused to block district’s policy. 9th Circuit Court of Appeals h also dismissed lawsuit after it found district’s plan sought to avoid discrimination and ensure safety and well-being of transgender students. court said that re is no 14th Amendment fundamental privacy right to avoid all risk of intimate exposure to or by a transgender person who was assigned opposite biological sex at birth. court found that denying transgender students ability to use same facilities as or students would amount to illegal discrimination.

LGBTQ vocates praise SC’s decision
Following Supreme Court’s decision, several LGBTQ vocates praised decision to reject appeal. y hailed it as an “excellent news” and said that trans students deserve an educational environment that is safe, supportive and free from discrimination.
