SC dismisses ex-BSF Jawan and SP candidate Tej Bahadur Yadav plea to overturn EC decision rejecting his Varanasi Lok Sabha poll nomination
Samajwadi Party's Varanasi contender ex-BSF Jawan Tej Bahadur Yadav's plea was dismissed by the Supreme Court challenging the decision of the Election Commission to reject his nomination from the constituency.

Ex-BSF Jawan and Samajwadi Party's Varanasi contender, Tej Bahadur Yadav's plea was dismissed by the Supreme Court, that challenged the decision of the Election Commission over the rejection of his nomination.
Tej Bahadur Yadav who was fielded in fray against Prime Minister Narendra in Varanasi, approached the apex court on Monday, wherein Advocate Prashant Bhushan appeared on his behalf.
The Election Commission had rejected SP candidates nomination for failing to provide information about the suspension from his government job. He did not submit the NOC from BSF to contest the polls
Republic TV had access to Yadav's petition to the Supreme Court which requested the SC to set aside the EC's order rejecting his nomination when he failed to produce a certificate which clarified that he has not been dismissed from duty for corruption or disloyalty to the state.
"Issue an appropriate writ or order or direction of similar nature to quash and set aside the order dated 01.05.2019, passed by the Returning Officer (Respondent No. 2) of the Election Commission of India (Respondent No. 1) rejecting the nomination paper no. 48/HP/2019/RO – dated 29.04.2019, filed by the Petitioner, on the ground of his failure to furnish a certificate [in view of Section 9 & Section 33 (3) of the Act of 1951] to the effect that he has not been dismissed for corruption or disloyalty to the state," reads the prayer in the petition.
The petition further requested the Supreme Court to issue an order and/or grant such other reliefs which would facilitate Yadav in contesting for the Varanasi polls.
"Issue an appropriate writ or order or direction of similar nature to allow the Petitioner to contest Lok Sabha Election, 2019 from the Parliamentary Constituency No. 77/Varanasi, in view of nomination paper no. 48/HP/2019/RO – dated 29.04.2019 already filed," stated the prayer.
On April 29, Samajwadi Party had replaced its candidate from Varanasi in Uttar Pradesh from Shalini Yadav to ex-BSF Jawan Tej Bahudar Yadav, who will fight against PM Narendra Modi for the constituency.
The ex-BSF jawan, a native of Rewari in Haryana, had posted a video online in 2017, complaining about poor quality food being served to the troops on the icy heights along the Line of Control (LoC) in Jammu and Kashmir. Following his video, the Summary Security Force Court (SSFC) had dismissed him after a trial.
