An American model, Emily O'Hara Ratajkowski and her company, Emrata Holdings Inc. has been sued over an Instagram post by a professional paparazzi photographer on October 23 for damages up to $150,000. The model posted a picture of herself carrying a bouquet of flowers, wearing an oversize blazer and tennis shoes as an Instagram story which was clicked by Robert O'Neil. Although the story disappears in 24 hours, the photographer has filed the lawsuit against Ratajkowski in the Southern District of New York, citing copyright infringement.

Claims by the photographer

The 28-year-old model was accused by Neil for not licensing his photograph along with not seeking permission or consent from him before posting it on her Instagram. Apart from the amount of $150,000, the photographer is reportedly also asking for all the profits which have been earned by the 28-year-old by the photographer's work and other unspecified monetary damages. The photo which  Ratajkowski has captioned as 'mood forever' which was clicked by Neil while she was covering her face during an outing in New York is not on Instagram anymore.

Gigi Hadid sued by photographer

This is not the first time than a model is being accused by their photographers for copyright infringement. While Ratajkowski has 24.4 million followers on Instagram, Gigi Hadid has 50.3 million followers and received a legal notice for posting a paparazzi photo of herself. Unlike the 28-year-old model, Hadid had publically posted about being sued for her now-deleted post and was informed by the management. Hadid had accused the paparazzi photographers of intruding the privacy of the celebrities "legally” and then asking for more after Hadid posted it. She further explains how she had seen the photo on Twitter without any credits to a photographer, and therefore had posted it on her page.
