Imposing Essential Services Maintenance Act (ESMA), Uttar Presh government has anunced on Friday, that act will be imposed for a period of six months. As per U.P ESMA, state government w has power to prohibit strikes in workplaces for next six months, after which it may be extended for ar six months. Mhya Presh too has imposed stringent ESMA amid Coronavirus pandemic.

UP imposes ESMA

Apart from making strikes illegal under ESMA, government is empowered with following powers:

  • Under ESMA, if any person strikes, it will be considered illegal and may face imprisonment for a term which may extend to six months or with fine which may extend to five hundred rupees or both.
  • Any police officer may arrest without warrant any person who is reasonably suspected of having committed any offence
  •  Orders issued under this law will be in effect in spite of being inconsistent with any or Uttar Presh Act for time being in force, essentially overriding or acts.

Uttar Presh amends labour laws

Uttar Presh, under CM Yogi ityanath, was first to pass an ordinance suspending all labour laws for three years except -Building and Or Construction Workers' Act, 1996, Workmen Compensation Act, 1923, Bonded Labour System (Abolition) Act, 1976, Part of Payment of Ws Act. Gujarat too has abolished all labour laws for three years except -Minimum Ws Act, Industrial Safety Rules, Employees' Compensation Act. Meanwhile, Shivraj Chouhan's Mhya Presh government has abolished certain labour laws.

Several Indian business experts have welcomed loosening of regulations stating that this move will provide flexibility and urge or states to bring in labour reforms. On or hand, worker unions have expressed ir dissatisfaction, stating that ir role will be diminished and want Centre to intervene. se laws have been sent to Centre for approval before it comes into force into respective states.

UP's migrant rush

Earlier in day, ditional Chief Secretary (Home) Awanish Awasthi, revealed that 930 trains have brought 12.33 lakh migrant workers, from or states till date. Moreover, Uttar Presh government instructed all district magistrates to arrange buses for migrant workers, who are found walking on foot, to send m to ir homes. While government has also banned entry of any migrants on foot and trucks in wake of three table trdy, killing 82 migrants travelling in trucks, government is currently, preparing a database of skills of incoming workers to provide employment to 20 lakh people as per ir skills.
